”माझे घर आणि गृहकर्ज” - लेख क्र. (४)
मित्रांनो, गेल्या वेळी मोफा
कायद्यातील कलम (३) ची ओळख करून घेत असतांना त्यात प्रामुख्याने प्रवर्तकाच्या सामान्य
जबाबदाऱ्यांचा उल्लेख आला होता. आज आपण कलम (४) ची ओळख करून घेणार आहोत ज्यातील
बारकावे आपणास निश्चितच उपयुक्त ठरतील आणि बिल्डर बरोबर करार करतांना कोणती काळजी
घ्यावयाची ह्याची पूर्वसूचना असल्याकारणाने बिल्डरबरोबर चर्चा करतांना आपल्याविषयी
निश्चितच काही प्रमाणात का होईना पण थोडा दबदबा निर्माण होईल. मोफा कायद्यातील कलम
(४) मधील प्रमुख तरतुदी खालिल प्रमाणे आहेत -
मोफा कायदा – कलम (४) – आगाऊ रकम आणि अर्धी रक्कम
घेण्यापूर्वी प्रवर्तकासाठीची प्रक्रिया
आगाऊ रक्कम आणि अर्धी रक्कम
घेण्यापूर्वी प्रवर्तकास करार करावा लागतो आणि तो करार नोंदणीकृत असावा लागतो.
१. कोणत्याही इतर कायद्यामध्ये
काहीही समाविष्ट असले तरीही, एक प्रवर्तक, जो इमारती किंवा घरे बांधतो किंवा
बांधण्यास इच्छुक असतो, त्यापैकी काही घरे किंवा सर्व घरे मालकी हक्कावर घेण्यात
येतात तेव्हा कोणत्याही प्रकारची रक्कम मान्य होण्यापूर्वी किंवा आगाऊ रक्कम आकारण्यापूर्वी
आणि ती रक्कम घराच्या पूर्ण रक्कमेच्या २०% पर्यंत पेक्षा जास्त असू नये आणि तशी
रक्कम आकारण्यापूर्वी करण्यात येणारा करार नोंदणीकृत असावा. {नोंदणी कायदा, १९०८
(XVI-१९००)}
अ) तपशील :-
१. बांधण्यात येणारी इमारत हि
योजनेनुसार आणि विशेषतेनुसार बांधण्याची
आणि ती योजना स्थानिक स्वराज्य संस्थेमार्फत मान्यताप्राप्त असावी,
२. ग्राहकास त्याने विकत घेतलेल्या घराचा ताबा करारामध्ये उल्लेख
केलेल्या तारखेस द्यावा लागतो.
५. ज्या व्यक्तींनी स्वतंत्र घर किंवा घरे घेतली आहेत त्यांनी एक संस्था
स्थापन करावी.
६. मर्यादित सामाईक जागा आणि सुविधा यांचे स्पष्टीकरण, विस्तार आणि
स्वभाव / पद्धत उल्लेख करण्यात यावा.
७.
अविभाज्य भागाची टक्केवारी सामाईक
जागांमध्ये आणि सुविधांमध्ये संबंधित असल्यावरच घराची विक्री केली जाऊ शकते.
८. घर ज्या कारणासाठी वापरण्यात येणार आहे त्याचे विधान द्यायला हवे आणि त्याच्यावर जर
काही बंधने असतील तर त्याचा उल्लेख करायला हवा.
ब) खालीस दस्तावेजाच्या प्रती
सदनिका खरेदी करणारास देणे :-
१. कायद्यामार्फत मिळवलेले
प्रमाणपत्रे किंवा वकिलाने दिलेले प्रमाणपत्र व त्याच्या प्रती,
२. मालमत्ता पत्र किंवा ग्राम नमूना
VI किंवा VII आणि XII चा उतारा किंवा इतर संबंधित महसूल नोंद जे प्रवर्तकाच्या
जागेच्या शीर्षकाचा प्रकार दर्शविते आणि ज्याच्यावर अवलंबून राहूनच घरे बांधली
आहेत किंवा बांधण्यात येणार आहेत, त्याची प्रत.
३. स्थानिक स्वराज्य संस्थेने / आयोगाने
प्रमाणित केलेल्या योजना आणि त्यांच्या मान्यतेची प्रत.
कलम ४(अ) – अनोंदणीकृत दस्तावेज –
कराराच्या विशिष्ट काम्गीरीसाठीची
फिर्याद हि अनोंदणीकृत कराराच्या आधारे देखील केली जाऊ शकते. जर कोणत्याही कारणाने
करार नोंदणी करण्याचा राहिला तर कोणत्याही कायद्यामध्ये काहीही सामाविष्ट असेल तरीही
तो पुरावा म्हणून घेतला जातो.
PROMOTER BEFORE ACCEPTING ADVANCE
PAYMENT OR DEPOSIT TO ENTER INTO AGREEMENT AND AGREEMENT TO BE REGISTERED.
Section (4) - (1) Notwithstanding anything contained in any other law, a promoter who
intends to construct or constructs a block or building of flats, all or some of
which are to be taken or are taken on ownership basis, shall before he
accepts any sum of money as advance payment or deposit, which shall not be more
than 20% of the sale price, enter into a written agreement for sale with
each of such persons who are to take or have taken such flats, and the
agreement shall be registered under the
Indian Registration Act ……………..
(1A) - The agreement to be
prescribed shall contain the following particulars, and to
such agreement copies of the documents need to be attached as specified in
clause (b)- {It is pertinent to
note that copies of the documents to be
attached would not be Xerox copies, but certified true copies of all such documents on Registration of the
Agreement.}
a)
Particulars
–
(i)
If the building is to be
constructed, the liability of the promoter to construct it according to the
plans and specifications approved by the local authority, where such approval
is required under any law for the time being in force,
(ii)
The date by which the possession
of the flat is to be handed over
to the purchaser,
(iii) The extent of the carpet area of the
flat including the area of the balconies which should be shown
separately,
(iv) The price of the flat including the
proportionate price of the common areas and facilities which should be shown
separately, to be paid by the purchaser of flat; and the intervals at which
installments thereof may be paid,
(v)
The precise nature
of organization to be constituted of the persons who have taken or are to
take the flats,
(vi) The nature, extent and description of limited common
areas and the facilities, ……………….. etc.
(x)
Percentage of undivided interests in the limited common
areas and facilities, if any,
pertaining to the flat agreed to be sold.
b)
Copies of documents:
(i)
The certificate by an Advocate (title
clearance certificate),
(ii)
Property card extracts / other
relevant revenue record showing the nature of the title of the promoter to the
land on which the flats are constructed or are to be constructed,
(iii)
The plans and specifications of
the flat as approved by the concerned local authority,
(2) Any
Agreement for Sale entered into shall be registered under Section 32 of the Registration
Act within the time allowed, and execution thereof shall be admitted before
the registering officer by the person executing the document or his represents,
assigns or agent ………….

Effect of non-registration of Agreement required to be registered under Section
(4):
Where an
agreement for sale entered into remains
unregistered for any reason, then notwithstanding anything contained in any law for the time
being in force, or in any judgment, decree or order of any Court, it may
be received as evidence of a contract in
a suit for specific performance under Chapter II of the Specific Relief
Act, 1963, or as evidence of part performance of a contract for the purpose of Section
53A of the Transfer of Property Act, 1882, or as evidence of any collateral
transaction not required to be effected by registered instrument.
