”माझे घर आणि गृहकर्ज” - लेख क्र. (५)
मागच्या लेखात आपण बांधकाम व्यावसायिकास रीतसर
करारनामा करण्यासाठी द्यावयाची कमाल रक्कम, ज्या प्रकल्पाचे बांधकाम करावयाचे आहे
त्यासाठी आवश्यक असणाऱ्या विविध खात्याच्या परवानग्या, वकिलाकडून प्राप्त करावयाची
प्रमाणपत्रे, सदनिका खरेदी करणारास बांधकाम व्यावसायिकाने जे दस्तावेज देणे अनिवार्य
आहे आणि जर संबंधित बांधकाम व्यावसायिकाने पैसे घेतल्यानंतर देखील आवश्यक करारनामा
केला नाही किंवा केलेला करारनामा रीतसर नोंदणीकृत केला नाही तर त्याचे सदनिका
खरेदीदारावर होणारे संभाव्य परिणाम तसेच सदनिका
खरेदी करणाराचे ह्या संपूर्ण प्रक्रियेत हितरक्षण ह्याविषयी सविस्तर माहिती घेतली.
आजच्या लेखात आपण मोफा कायद्याच्या कलम (५) आणि कलाम (६) ची ओळख करून घेणार
आहोत ज्यानुसार प्रवर्तकाने सदनिका खरेदी करणारांकडून देय / आगाऊ रक्कम
स्वीकारल्यास त्याचे विनियोजन कसे करणे आवश्यक आहे ह्या विषयी विवेचन करण्यात आले
आहे.
मोफा कायदा – कलम ५ –
“प्रवर्तकाने स्वतंत्र खाते आगाऊ रकमेसाठी चालू ठेवणे आणि त्यासाठी सदनिका खरेदी
करणारांचा ‘विश्वस्त’ म्हणून व्यवहार करणे –
(अ)
प्रवर्तकाने प्रत्येक प्रकल्पासाठी एक स्वतंत्र बँक खाते चालू करावे,
(आ)
त्यामध्ये सदनिका खरेदी करणारांकडून (प्रकल्पाशी
संबंधित) प्राप्त आगाऊ ठोक रक्कम जमा करावी,
(इ)
ह्या जमा रकमेसाठी प्रवर्तक हा (सदनिका घेणारांचा) विश्वस्त म्हणून कार्यरत राहील,
आणि
(ई)
हि
रक्कम प्रवर्तकाने (संबंधित प्रकल्पांशी संबंधित) आवश्यक अशा कामासाठी(च) खर्च करणे अनिवार्य आहे.
कलाम (५) (अ) – राज्य सरकार कार्यालयीन
राजपत्रात सूचित करून एक अधिकारी नियुक्त करते आणि त्याचे पद सहकारी संस्थांमधील
उपनिबंधकापेक्षा कमी नसते आणि तो एक सक्षम अधिकारी आयोग असतो जो अधिसूचनेत सूचित
केल्याप्रमाणे एक किंवा अधिक क्षेत्रांसाठी कार्यरत असतो. त्यांना हेतुपूर्तीसाठी अधिकार देण्यात येतात
आणि ते त्यांची कार्ये या कायद्याच्या कलम ५, १० आणि ११ अंतर्गत कार्यरत असतात.
कलाम (६) – “ देण्यात
येणाऱ्या करांचा भरण्याची जबाबदारी”
जेव्हा प्रवर्तकाकडे मालमत्तेचा ताबा असतो आणि ज्या ग्राहकांनी घर
खरेदी केले आहे त्यांचाकडून तो बाहेर जाणाऱ्या करांसाठी रक्कम घेतो तेव्हा त्या
सर्व शुल्काचा व करांचा भरणा (जसे तळमजला
भाडे महानगरपालिका किंवा इतर कर, पाणीपट्टी भाडे, वीज शुल्क, महसूल कर आणि असे इतर
सर्व कर समाविष्ट असतात) जेव्हापर्यंत तो मालमत्तेचा ताबा ग्राहकास सोपवत
नाही तेव्हापर्यंत करण्याची त्याची
जबाबदारी असते.
(जर काही कारणास्तव प्रवर्तक ती संबंधित करांची रक्कम भरण्यास
असमर्थ ठरला आणि त्यांनी ग्राहकांकडून ती रक्कम घेतलेली असली तर अशा प्रकरणामध्ये
प्रवर्तक, घराचा ताबा ग्राहकास सोपविल्यानंतरही संबंधित कर आणि त्याच्यावर जर काही
प्रलंबित शुल्क लागलेले असेल तर ते भरण्यास जबाबदार असतो.)
SECTION (5) - PROMOTOR TO MAINTAIN SEPARATE ACCOUNT OF
SUMS TAKEN AS ADVANCE OR DEPOSIT AND TO BE TRUSTEE THEREFOR; AND DISBURSE THEM
FOR PURPOSE FOR WHICH GIVEN
The promoter shall maintain
a separate account in any Bank of sums taken by him from persons intending to take or who have
taken flats, as advance or deposit including any sums so taken towards the
share capital for the formation of co-operative society or a company, or
towards the outgoings (including ground rent, if any, municipal or other local
taxes, taxes on income, water charges, electricity charges, revenue assessment,
interest on any mortgage or other encumbrances,
if any); and he shall hold the said money for the purposes for which they
were given and shall disburse the moneys for those purposes and shall on
demand in writing by (a Competent authority, make full and true disclosure of
all such transactions in respect of that account).
[SECTION 5A-
COMPETENT AUTHORITY] –
The State Government may, by
notification in the Official Gazette, appoint any officer not below the rank of
the District Deputy Registrar of Co-operative Societies, to be the competent
Authority, for an area or areas to be specified in such notification and
different officers may be appointed as Competent Authority for different local
areas, for the purposes of exercising the powers and performing the duties
under Sections 5, 10 and 11 of this Act}
SECTION (6) – “RESPONSIBILITY
FOR PAYMENT OF OUTSTANDINGS TILL PROPERTY IS TRANSFERRED”
A promoter shall, while he
is in possession and where he collects from persons who have taken over flats
or are to take over flats sums for the payment of outgoings ever thereafter,
pay all outgoings (including ground rent, municipal or other local taxes, taxes
on income, water charges, electricity charges, revenue assessment, interest
on any mortgage or other encumbrances,
if any), until he transfers the property to the persons taking over the flats,
or to the organization of any such persons.
Where any promoter fails to
pay all or any other outgoings collected him from the persons who have taken
over flats or are to take over flats, before transferring the property to the
persons taking over the flats or to the organization of any such persons, the
promoter shall continue to be liable, even after the transfer of the property,
to pay such outgoings and penal charges (if any) to the authority or person to
whom they are payable and to be responsible for any legal proceedings which may
be taken therefor by such authority or person.
