“ग्राहक जागरण आणि प्रबोधन अभियान” या
मोहिमेंतर्गत हा दुसरा लेख आपले सन्माननीय सहोदर आणि ग्राहक वर्ग ह्यांना समर्पित
करतांना मला मनस्वी खूप आनंद होत आहे. जिव्हाळ्याचा विषय असलेली वास्तू घेण्याचे
मनात येताच सर्वप्रथम दोन गोष्टींचे बाबतीत आपण सजग होतो आणि तशी तयारी करण्यास
देखिल सुरुवात करतो. त्यातिल पहिली म्हणजे घर / वास्तू कोठे घ्यायची आणि दुसरी
म्हणजे त्यासाठी लागणारी आवश्यक कागदपत्रे आणि वित्तीय संस्थांकडून मिळणाऱ्या
गृहकर्जाची कमाल मर्यादा. ह्या दोन्हीही गोष्टींसाठी “कागदपत्रे” आणि “दस्तावेज”
हे अत्यंत महत्वाचे असल्याने आजचा विषय “घर खरेदी आणि गृहकर्ज – आवश्यक दस्तावेज / कागदपत्रे” हाच निवडला आहे. कारण घर
/ गृहकर्ज घेण्यासाठीचा श्रीगणेशा त्यापासूनच होत असल्याने सुरुवातीचा महत्वपूर्ण
कालखंड आणि उर्जा / शक्ति ह्याच दोन विषयांवर खर्ची पडत असते. त्या
अनुषंगाने आवश्यक दस्तावेजांची सर्वसाधारण यादी देत आहे.
२. येथे
खुलासेवजा माहिती देणे आवश्यक आहे असे वाटते. बऱ्याच वेळा मोफा कायद्यांतर्गत
आवश्यक गोष्टींची पूर्तता – जसे सहकारी गृहनिर्माण संस्थेची स्थापना करणे आणि त्या
नंतर विहित कालावधीत इमारतीखालील जमिनींचे अभी-हस्तांतरण करणे या प्रक्रिया –
विहित कालावधीत बिल्डर द्वारा पूर्ण
करण्यात येत नाहीत. परिणामी प्रत्येक वेळी सदनिकांच्या हस्तांतरणासाठी /
पुनर्विक्रीसाठी “ना-हरकत प्रमाणपत्र” (N.O.C.) देण्यासाठी ग्राहकांकडून रोखीने व
प्रती चौ. फुट प्रमाणे पैसे वसूल करणे इत्यादी बेकायदेशीर प्रकार वारंवार घडत
असतात. वास्तविक सदनिकांची विक्री / पुनर्विक्री करतांना मोफा कायदा १९६३ अथवा
मोफा नियम १९६४ नुसार विकासकाच्या कोणत्याही “ना-हरकत प्रमाणपत्राची” (N.O.C.)
आवश्यकता नाही. असे ना-हरकत प्रमाणपत्र घेण्याचे कोणतेही बंधन कायद्यात नाही.
परिणामी, त्याशिवाय होणारी नोंदणी प्रक्रिया हि कायद्यानुसार योग्य आहे हे येथे
लक्षात घेणे आवश्यक आहे.
३. गृहकर्जासाठी
आवश्यक कागदपत्रांची हि यादी (CHECK LIST) भारतीय स्टेट बँक, पौड रोड, पुणे शाखेचे मुख्य व्यावास्थापक श्री. दीपक मालखेडे
सर आणि कर्जविभागातील अधिकारी श्री सुहास देशपांडे सर ह्यांनी उपलब्ध करून दिलेली
आहे. त्याबद्दल मी व्यक्तीशः दोघांचा ऋणी आहे. त्यांनी दिलेल्या यादीत (cheklist) काही
ठिकाणी समजण्यास सोयीस्कर व्हावे म्हणून काही खुलासे / स्पष्टीकरण केलेले आहेत जे ‘कंस’
देऊन टाकलेले आहेत.
४. आजच्या
लेखासंबंधी काही सूचना असल्यास
त्याचे निश्चितच स्वागत आहे. कारण
त्यामुळे हि लेखमाला अजून समर्पक, उपयुक्त आणि सर्वसमावेशक होण्यास मदतच होईल.

या प्राथमिक माहितीनंतर दि. २९/०३/२०१७ पासून मोफा कायदा-१९६३ मधील काही
महत्वाच्या तरतुदींचा उहापोह करण्याचा प्रयत्न करणार आहे.

Account statement for one year. {This is with a view to ascertain whether the
loan instalments were paid in time or were in default at any given point of
time.}

Power of Attorney
in Bank’s format (Applicable only in case the housing loan is applied by a
NRI or Defense Personnel.)

Report / Search report from Bank’s empanelled advocate – for 13 years (or for
30 years). (This search report is in
