ग्राहक चळवळीशी प्रत्यक्ष आणि अप्रत्यक्षपणे
संबंधित सहोदरांनो,
“माझे घर आणि गृहकर्ज” ह्या विषयाची प्राथमिक स्वरूपाची माहिती मागच्या लेखात करून
घेतल्यानंतर आजपासून आपण थोड्या गंभीर आणि महत्वाच्या विषयास सुरुवात करीत आहोत, आणि
ती म्हणजे गृहखरेदी आणि गृहकर्जासाठी
आवश्यक गोष्टींची पूर्तता करण्यातील एक महत्वाची बाब म्हणजे बिल्डरला बुकिंगची
रक्कम देणे आणि त्यानंतर महाराष्ट्र स्वतंत्र मालकी ह्क्क्काचे घर (बांधकामांची
वाढीसंबंधी नियम, विक्री, व्यवस्थापन आणि बदली) कायदा, १९६३ ह्या कायद्यातील
महत्वाच्या तरतुदींची माहिती करून घेणे. जनमानसात हा कायदा मुख्यत्वे ‘मोफा कायदा”
ह्या नावाने मोठ्या प्रमाणावर माहित आहे. बराच विचार केल्यानंतर
मी अशा निर्णयाप्रत आलो कि सर्वांच्या
जिव्हाळ्याच्या कायद्यातील महत्वाच्या तरतुदी ह्या केवळ मराठी किंवा इंग्रजी भाषेत
न देता दोन्हीही भाषांमध्ये द्याव्या. त्यामुळे ज्याला जी भाषा सोयीस्कर वाटेल
त्या भाषेतून “ग्राहक प्रबोधन” हे जे आपले उद्दिष आहे ते साध्य करणे शक्य होईल. कारण भाषा हे शेवटी
आपापसातील संवादाचे माध्यम आहे, ते उद्दिष्ट निश्चितच नाही. त्यामुळे आजपासून पुढील काही लेख हे मोफा
कायद्यातील महत्वाच्या तरतुदींची ओळख करून घेणे ह्याभोवती केंद्रित असतील. तर चला, अधिक वेळ न दवडता मुख्य
विषयाचा श्रीगणेशा करू या.
२. या कायद्याच्या तरतुदी सर्वसाधारणपणे सदनिका व सदनिकाधारक यांच्याशी
संबंधित आहेत. सदनिका खरेदी कार्ण्यापासूनची प्रक्रिया या कायद्यामध्ये अंतर्भूत केलेली
आहे. इमारत बांधतांना विकासकाची जबाबदारी व फ्लॅट खरेदीदाराची जबाबदारी या
कायद्यानुसार स्पष्ट करण्यात आली. मुख्य म्हणजे फ्लॅट खरेदी करतांना ग्राहकाने
घेण्याची काळजी तसेच त्याच अनुषंगाने विकासकाने एखाद्या प्रकल्पाबाबत पूर्ण माहिती
देणे बंधनकारक झाले. “महाराष्ट्र सरकारविरुद्ध महावीर राठोड” तसेच “स्वरूप बिल्डर्स
विरुद्ध शेख सांघी व इतर” या मध्ये विकासकाविरुद्ध फौजदारी कारवाई कोणत्या
अधिकारात व केंव्हा करता येईल याबाबत स्पष्टता आणण्यात आली. तसेच गच्ची किंवा
टेरेसच्या विक्रीबाबत सर्वप्रथम “रामगौरी विरानी विरुद्ध वाळकेश्वर त्रिवेणी
सोसायटी” या निकालामध्ये टेरेस किंवा पार्किंगबाबतच्या तरतुदी स्पष्ट करण्यात
आल्या.
३. वर उल्लेख केल्या प्रमाणे मूळ मोफा कायद्यातील काही महत्वाच्या तरतुदींचा
उहापोह आजपासून पुढे काही दिवस करण्याचा
प्रयत्न करणार आहे. ह्या तरतुदी उधृत करण्याबरोबरच
आवश्यक तेथे ह्या तरतुदी समजण्यास सोपे व्हावे म्हणून त्यामागील अन्वयार्थ देण्याचा
प्रामाणिक प्रयत्न देखील केला आहे. आज
सुरुवातीस आपण ह्या कायद्यातील कलम (३) ची ओळख करून घेऊ या.
कलम
(३) – प्रवर्तकाच्या जबाबदाऱ्या (केवळ महत्वाच्या जबाबदाऱ्यांचा उल्लेख केलेला आहे) (सुरुवातीचे अक्षर / अंक हे पोट-कलमांशी संबंधित असतीलच असे नाही).
ब) एक प्रवर्तक जो बांधकाम करू
इच्छितो किंवा बांधकाम करतो त्यास खालील प्रमाणे जबाबदाऱ्या असतात –
१.
ज्या जागेवर संबंधित घरे बांधण्यात आलेली आहेत किंवा
बांधण्यात येणार आहेत त्यासंबंधीच्या शीर्षकाच्या प्रकाराचे संपूर्ण आणि सत्य अशी
माहिती उघड करणे आणि तसे शीर्षक त्या जागेस दिलेले आहे त्याची कायद्याने नोंदणी व
प्रमाणपत्र, जे एका वकिलामार्फत मिळते, ते ठेवणे, आणि जो वकील तशी नोंदणी देत असतो
तो (३) वर्षांपेक्षा जास्त कार्यरत असावा.

संबंधित जमिनीवर असलेले काही अधिकार, शीर्षक व्याज किंवा
दाव्या विषयीचे काही अडथळे किंवा ओझे असतील तर त्या विषयीची संपूर्ण व सत्य माहिती
उघड करणे.
३.
वस्तू, उपकरणे आणि इतर आवश्यक सुविधा (एक किंवा अधिक
उद्वाह्ना विषयीच्या (lift) तरतुदी समाविष्ट) ज्या उपलब्ध आहेत अथवा उपलब्ध करून
देण्यात येणार आहेत त्याविषयीची पूर्ण माहिती देणे.
४.
ज्या तारखेस घराचा ताबा देण्यात येणार आहे त्या तारखांचे
लेखी स्पष्टीकरण देणे (आणि त्याच योग्य तारखेस घराचा ताबा ग्राहकास सोपवणे).
५.
कोणत्याही व्यक्तीस पूर्णत्व प्रमाणपत्र (completion
certificate) मिळाल्याशिवाय सदनिका ताब्यात घेऊ
देण्यास परवानगी न देणे. (कोणतीही व्यक्ति संबंधित घराचा ताबा, तसे पूर्णत्व
प्रमाणपत्र स्थानिक स्वराज्य संस्थांकडून मिळविल्याशिवाय घेऊ शकत नाही.)
SECTION (3) – GENERAL LIABILITIES OF PROMOTER
1) Notwithstanding
anything contained in any other law, a promoter who intends to construct or
constructs a block or building of flats, all or some of which are to be taken
or taken on ownership basis, shall in all transactions with persons intending
to take or taking one or more of such flats, be liable to give or produce or
cause to be given or produced, the information and the documents hereinafter in
this section mentioned.
2) A promoter, who constructs or intends to
construct such block or buildings of flats, shall –
a) Make full and true disclosure of the nature
of his title to the land on which the flats are constructed, or to be
constructed, such title to the land as aforesaid having been duly certified by
an Attorney-at-Law, or by an Advocate
of not less than three years’ standing and having duly entered in the
property card or extract of Village Forms V or VII and X or any other relevant
revenue records,
b) Make full and true disclosure of all encumbrances on such land,
including any right, title, interest or claim of any party in or over such
land,
c) Give inspection on seven days’ notice or demand, of the plans
and specifications of the building built or to be built on the land; such plans and specifications
having been approved by the local authority which he is required so to
do under any law for the time being in force,
d) Disclose the nature of fixtures, fittings
and amenities (including the provision for one or more lifts) provided or to be
provided,
f) Specify in writing the date by which
possession of the flat is to be handed over and shall hand over such possession
accordingly,
h) State in writing, the precise nature of the
organization of persons to be constituted and to which title is to be passed,
and the terms and conditions governing such organization of persons who have
taken or are to take the flats,
i) Not allow persons to enter into possession
until a completion certificate, where such certificate is required to be given
under any law, is duly given by the local authority (and no person shall take
possession of a flat until such completion certificate has been duly given by
the local authority),
j) Make full and true disclosure of such
other information and document, in such
a manner as may be prescribed; and give on demand true copies of such of the
documents referred to in any of the clauses of this sub-section as may be
prescribed, at a reasonable charge therefor.
l) Display or keep all the documents, plans
or specifications (or copies thereof) referred to in clauses (a), (b) and (c),
at the site and permit inspection thereof to persons intending to take or
taking one or more flats,
m) When flats are advertised for sale, disclose
inter alia in the advertisement the following particulars namely …
n) Sell flat on the basis of the carpet area
only.
Explanation – For the
purpose of this clause, the carpet area of the flat shall include the area of
the balcony of such flat.
